§ 1 Statutory definitions

  1. Shop - the online shop available at www.turdus.pl through which the Buyer may purchase the Products available in the Shop.
  2. Seller - TURDUS STORE EWA SCHWARTZ ul Kościelna 14, 63-210 Żerków e-mail: contact@turdus.pl tel: 508981114, NIP: 7772757267
  3. Terms and conditions of the online shop - these terms and conditions for the provision of services by electronic means, setting out the rules for the use of the Shop, available at: turdus.pl.
  4. Privacy Policy - document describing the purposes and means of data processing, as well as the rights of data subjects.
  5. Consumer - a natural person of full legal capacity making a purchase at the Seller not directly connected with his/her economic or professional activity.
  6. Buyer - the person making a purchase from the Shop
  7. User - a person using the Seller's website or Shop, not entering into an agreement for the sale of a Product, using free electronic services offered by the Seller

  9. Order - a declaration of will made by the Buyer aimed directly at concluding a contract with the Seller by completing and submitting an electronic purchase form available on the Shop's website, including reading and accepting the Rules and Regulations of the online shop.
  10. Product - the product offered and sold by the Seller and available in the Shop.

§ 2 General provisions

  1. The prices given by the Seller are expressed in Polish zloty [PLN] and are gross prices.
  2. In addition to the price currently in force, the Seller shall indicate next to each Product its lowest price in the last 30 days.
  3. The Seller may provide Users with discount codes which, when entered into the field indicated for this purpose in the Order Form, will reduce the price of the Product.
  4. The Seller undertakes to deliver Products free of defects.
  5. The User and the Buyer are obliged to use the Shop in accordance with the provisions of the Terms and Conditions, as well as not to provide content prohibited by generally applicable laws and to respect the personal copyrights and property rights of the Seller.
  6. The Buyer is obliged to familiarise himself with the technical requirements necessary for the use of the Services, as further set out in the Terms and Conditions (Technical Requirements).

§ 3 Forms of payment

  1. The seller provides the buyer with the option of payment via the Przelewy24 system.
  2. The payment operator for payments via the Przelewy24.pl system is PayPro SA, ul. § 4 Conclusion of the sales contract

  1. To order a Product through the Shop, visit the Shop website,
    i.e. www.turdus.pl and then select the relevant Product or Products
    and add them to the virtual shopping basket by following the information displayed on the Shop's website.
  2. In order to place an Order, it is necessary for the Buyer to perform the following steps:
    1. adding the Product to the basket,
    2. filling in the order form with data such as the first and last name of the buyer,
    3. providing the e-mail address used to receive correspondence, including confirmations of acceptance and execution of the Order,
    4. choosing your preferred form of delivery for the Product,
    5. he/she is acquainted with the rules of the Shop and accepts its provisions by ticking the appropriate
      check-box found at the end of the order form,
    6. confirmation of the will to conclude a contract, including the selection of the "Order with obligation to pay" button
      or equivalent content,
    7. to proceed to the Operator's payment system and complete the transaction through it.
  3. Once the Buyer has provided all the data necessary to place the Order,
    a summary of the Order is displayed.
  4. An order sent by the Buyer is a declaration of intent by the Buyer to conclude with the Seller.

  5. After the Order has been placed, the Buyer shall receive a message confirming the Order, which shall constitute a
    the Seller's declaration of intent to conclude a sales agreement with the Buyer including the File.
    The sales contract is deemed to have been concluded as soon as the Buyer has received the message from the Seller.
  6. The buyer cannot make a purchase from the Shop anonymously or under a pseudonym.
    In the Order Form, the Buyer must provide true personal data.
    The purchaser is responsible for all consequences of providing false personal data.
  7. The content of the concluded Sales Agreement shall be recorded, secured and made available to the Customer by means of:
    1. making these Terms and Conditions available on the Platform,
    2. sending an e-mail to the customer.
  8. The content of the Sales Contract and any consents given by the Buyer shall be further recorded.

§ 5 Seller's obligations

  1. The Seller proceeds with the processing of the Order placed once payment has been authorised.
  2. The Product shall be delivered to the Buyer in the manner chosen by the Buyer by means of the services provided by the company. DPD or INPOST or by personal collection.
  3. The Seller undertakes to ensure that access to the Shop is uninterrupted and takes care of the security of transactions carried out with the use of the Shop, with the payment operators being the entity indicated in § 3 of the Terms and Conditions.
  4. The Seller shall not be liable for any damage incurred by the Buyer as a result of the faulty functioning of the equipment with which the Buyer uses the Shop.
  5. The vendor is not responsible for the functioning of interfaces and links that are not owned or operated by the vendor.
  6. The Seller is not responsible for any disruptions, including breaks, in the functioning of the Shop caused by force majeure or unauthorised actions of third parties. However, the Seller reserves the right to planned breaks, for example due to technical modifications, of which the Customer will be informed on the Shop website.
  7. The Seller undertakes to fulfil the Orders within the agreed timeframe declared with the information on the Products.

§ 6 Cost, means and time of delivery

  1. The start of the period for delivery of the goods shall be calculated from the date on which the Seller's bank account or settlement account is credited.
  2. Delivery of the goods is available in Poland.
  3. The delivery of goods to the Customer is chargeable, and/or if the Sales Agreement provides otherwise. The costs of delivery of the goods (including transport, delivery and postal charges) are indicated to the Customer on the Shop's website and during the placement of the Order, including when the Customer expresses his/her will to be bound by the Sales Contract.
  4. The Seller shall make the following methods of delivery of the goods available to the Customer:
  5. courier service via DPD
  6. delivery by parcel service of Inpost.
  7. The seller undertakes to dispatch the consignment as expeditiously as possible, but shall not be liable for any delays in delivery which are through no fault of the seller.
  8. If the Customer provides an incorrect or inaccurate address, the Seller shall not be liable for non-delivery or delay in delivery of the Order.
  9. Czas realizacji zamówienia wynosi maksymalnie 3 dni robocze od momentu zaksięgowania płatności na rachunku bankowym lub koncie rozliczeniowym Sprzedawcy. Do tego czasu należy doliczyć okres dostawy, który zależy od wybranego sposobu wysyłki.

§ 7 Complaints and returns

  1. Within 14 days of receipt of the Product, the Buyer has the right to exercise his statutory right to withdraw from the distance contract and return the Product without giving any reason, in which case the Seller shall return to the Buyer the full amount he paid for the returned Product within 14 days. The condition is that the Product is returned to the Seller undamaged, in a condition that does not indicate its use by the Buyer.
  2. The Buyer shall bear the costs of sending the Product back to the Seller, although the return may also be delivered personally to the Administrator.
  3. The Buyer also has the right to make a complaint about a Product purchased through the Shop and the website.
  4. Complaints can be made by e-mail to the following address

    or by post to TURDUS STORE ul. Kościelna 14, 63-210 Żerków and should include:
    1. order number,
    2. the Buyer's details (first name, surname, name, e-mail used to place the order, description of the irregularity - optionally enriched with photographs presenting the irregularity - as well as the claim resulting from the circumstances).
  5. The seller responds to the complaint within 14 days and replies by e-mail to the e-mail address provided by the buyer on the order form.

§ 8 Protection of personal data

  1. The administrator of the personal data provided during the use of the Shop is the Seller.
  2. Any person whose personal data is processed by the Vendor has the right to:
  • their individual control

  • their rectification and completion

  • their removal

  • restrictions on their processing

  • their transfers

  • to lodge a complaint with a supervisory authority.

  1. The purposes, principles and scope of data processing, the entities to which the data will be transferred, as well as the rights of the data subjects are described in the Privacy Policy available at www.turdus.pl.
  2. The Privacy Policy regulates the principles of data processing related to the processing of personal data and the use of cookies and other tracking technologies in connection with the use of the Shop's contact form, placing and processing of Orders in the Shop, conducting e-mail contact (including enquiries via the contact form on the website) with the Seller.
  3. For all data protection issues, the customer can contact:

§ 9 Technical requirements for using the Shop and the Products

  1. In order to use the Shop and the Products and Services, it is necessary for the Buyer to have:
    1. Internet-enabled devices (computer, tablet, phone),
    2. a properly configured cookie-capable Internet browser - Internet Explorer, Opera, Mozilla Firefox, Safari, Google Chrome (recommended Mozilla Firefox version minimum 24.0, Opera from version 10, Google Chrome version 28.0 or later or MS Internet Explorer version minimum 8.0 or later), which provides support for cookies and scripts Javascript. It is acceptable to use other versions of web browsers if they provide full compatibility with the versions listed above,
    3. an active and suitably configured e-mail account, enabling the Buyer to receive messages.
  2. For the safe use of the Shop and its Products, it is recommended that the device used by the Buyer should also have, in particular:
    1. up-to-date antivirus system,
    2. an effective security firewall,
    3. installed available updates to the operating system and web browser which relate to security,
    4. the function for accepting cookies and Java Script is activated in your browser,
    5. software enabling the reading of files in .PDF format.
  3. The Seller shall not be liable for the Buyer's failure to comply with the above technical requirements necessary for the cooperation with the ICT system used by the Buyer. In particular, this concerns cases where the Buyer has incorrectly configured his e-mail account or has not configured his e-mail account at all and e-mails from the Buyer to the Seller or from the Seller to the Buyer do not reach him for this reason.

§ 10 Dispute resolution

  1. The consumer has the possibility to use out-of-court complaint and redress procedures. Among other things, he has the possibility to:
    1. apply to a permanent amicable consumer court for the settlement of a contractual dispute,
    2. apply to the regional inspector of the Commercial Inspection to initiate mediation proceedings for an amicable settlement of the dispute between the Customer and the Seller,
    3. seek the assistance of the district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection.

The consumer can also use the ODR platform, which is available at
http://ec.europa.eu/consumers/odr.
The platform serves to resolve disputes between consumers and traders seeking out-of-court resolution of disputes concerning contractual obligations arising from an online sales or service contract.

§ 10 Final provisions

  1. Matters not covered by these Online Shop Regulations shall be governed by the relevant generally applicable provisions of Polish law, in particular the Civil Code.
  2. The terms and conditions of the Seller's services are set out exclusively in the Terms and Conditions. Any information or advertising materials regarding the cooperation are for information purposes only and are not legally binding.
  3. The place of performance is in particular the designated place to which the Seller is contractually obliged to send the Product to the Buyer.
  4. The consumer also has the right to refer the dispute to an entity entitled to out-of-court resolution of consumer disputes in accordance with the Act on Out-of-Court Resolution of Consumer Disputes (Journal of Laws 2016.1823 of 2016.11.09) without prejudice to the possibility of bringing an action before the ordinary courts.
  5. The seller provides current access to the current content of the terms and conditions at: www.turdus.pl.
  6. These Terms and Conditions of the online shop shall enter into force on the day they are published on the Seller's website.
  7. The Seller reserves the right to amend these Terms and Conditions at any time, while informing you by email.
  8. The new or amended Terms and Conditions shall enter into force 14 days after publication on the Seller's website.
